Florida Prenup for a Vietnamese Spouse or Marriage in Vietnam (2026)
Pazos Law Group, a family law firm in Coral Gables, drafts and reviews Florida prenups for couples marrying in Vietnam or with a Vietnamese spouse, in English or Spanish. For a wedding in Vietnam followed by life in Florida, coordinate the agreement with the marriage-registration date and obtain separate advice in both jurisdictions.
Quick Answer
When should a couple with Vietnam ties arrange a Florida prenup?
Before marriage, with independent counsel and translation for informed consent. Vietnam’s article 47 requires an agreed property regime before marriage registration, in writing, notarized or certified, effective from registration. Florida requires a writing signed by both parties; certain death-rights waivers have a separate two-witness rule. Pazos Law Group advises on Florida law only; questions about Vietnamese law need a lawyer licensed there.

Confirm the marriage-registration date with Vietnamese counsel before arranging signatures. Article 47 calls for the agreed regime to be made before marriage registration, in writing, notarized or certified, and effective from registration. A later celebration or move to Florida should not be used as the planning date without that advice.
The Florida Draft: Terms, Disclosure and Consent
Section 61.079(3) states: A premarital agreement must be in writing and signed by both parties.
Under subsection (5), it becomes effective upon marriage. Subsection (4) permits terms about property rights and management, disposition on separation or death, spousal support, estate arrangements, life-insurance death benefits and the law governing construction of the agreement. Those permissions have limits, including: The right of a child to support may not be adversely affected by a premarital agreement.
Section 61.079(7)(a) provides distinct grounds for nonenforcement in proceedings under the Florida Family Law Rules of Procedure: involuntary signing; fraud, duress, coercion or overreaching; or an agreement unconscionable when executed together with all three financial-information conditions. Those conditions are lack of fair and reasonable disclosure, no voluntary and express written waiver of further disclosure, and no adequate knowledge or reasonable ability to have that knowledge. Incomplete disclosure alone is not a complete statement of that third ground.

Independent Advice, Video Review and Translation
Each spouse should have independent counsel. Arrange review by video if one person is in Vietnam, sending the complete draft and financial schedules to that person’s lawyer. Identify assets, debts, currencies and valuation dates. Arrange translation and interpretation as needed so consent is informed; English or Spanish services do not imply Vietnamese-language services. Check that translated documents reflect the final changes.
Death-Related Waivers Need a Separate Witness Check
A prenup that waives the surviving-spouse rights listed in § 732.702(1), such as elective-share or homestead rights, needs a separate execution analysis. The statute requires a written waiver signed by the waiving party in the presence of two subscribing witnesses
. It limits that witness requirement to waivers signed by Florida residents after the law’s effective date. It also recognizes a nonresident’s waiver if valid when executed under the law of the state or country of execution, even if that person later resides in Florida at death. Counsel should determine residency and the applicable formalities; a trip abroad does not settle either question. Notarization does not replace required witnesses.

Coordinate the Two Signing Plans
Florida § 61.079(3) does not itself require notarization; article 47’s Vietnamese requirement is a separate issue. Vietnamese counsel should confirm the lawful notarization or certification procedure and any local requirements. Florida counsel should confirm Florida execution and witnesses. Video review does not establish remote-signing eligibility, and Pazos Law Group does not represent that it notarizes documents abroad.
Before Marriage Registration
- Give both lawyers the registration date and any existing agreement.
- Exchange financial records and arrange independent review and translation.
- Confirm the final text, local formalities and Florida witness requirements before signing.
Frequently Asked Questions
Will notarization alone make the agreement enforceable in both places?
No result is promised. Article 50 addresses Vietnamese invalidity grounds, while Florida § 61.079(7)(a) addresses Florida enforcement. Each lawyer must assess the relevant law. A notarial act does not replace independent advice, informed consent or applicable witnesses.
